Terms of Service

1. Agreement to Terms
By accessing or using the services provided by LumetraPixelStudio, registered at Rua Damasceno Monteiro 95, 1.º B, 1170-110 Lisboa, Portugal, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Service Scope
LumetraPixelStudio provides web development, API architecture, cloud infrastructure, and related technical services. Service specifications, deliverables, timelines, and pricing are defined in individual project proposals and statements of work agreed upon prior to commencement.
3. Project Engagement & Milestones
- All projects begin upon receipt of the agreed deposit (typically 40% of total project value).
- Progress milestones are defined in the project proposal and confirmed via written communication.
- Client feedback is required within 5 business days of each milestone delivery to maintain the agreed timeline.
- Delays in client feedback may result in timeline extensions proportional to the delay.
4. Payment Terms
- Invoices are issued upon milestone completion and are payable within 14 days.
- Payments are processed via Stripe. All prices are denominated in Euros (€) unless otherwise specified.
- Late payments incur a 2% monthly administrative fee after a 7-day grace period.
- Services may be suspended for accounts more than 30 days overdue.
5. Intellectual Property
Upon full payment, all intellectual property rights for deliverables are transferred to the client. LumetraPixelStudio retains the right to display completed work in portfolio materials unless explicitly prohibited in the project agreement. Third-party libraries, frameworks, and tools remain subject to their respective licenses.
6. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 24 months. Confidential information shall not be disclosed to third parties without prior written consent.
7. Limitation of Liability
LumetraPixelStudio's total liability for any claim arising from or related to the services shall not exceed the total amount paid by the client under the relevant project agreement. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data loss.
8. Warranty
All deliverables are warranted to function as specified in the project proposal for a period of 90 days following final delivery. This warranty covers defects in workmanship and does not cover issues arising from unauthorized modifications, third-party integrations, or environmental factors outside our control.
9. Termination
Either party may terminate the agreement with 14 days' written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Deposits are non-refundable for work already commenced.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Portuguese Republic. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisboa, Portugal.
Refund & Reimbursement Policy

1. Refund Eligibility
LumetraPixelStudio, registered at Rua Damasceno Monteiro 95, 1.º B, 1170-110 Lisboa, Portugal, offers refunds under the following conditions:
- Full refund: If no work has commenced and cancellation is requested within 48 hours of deposit payment.
- Partial refund: Proportional to work not yet completed, minus a 15% administrative fee, if cancellation occurs after work has begun.
- No refund: For completed milestones or deliverables that have been accepted and approved by the client.
2. Milestone-Based Refunds
Projects are structured around milestones. If a project is cancelled mid-engagement:
- All completed and approved milestones are non-refundable.
- The current in-progress milestone is eligible for a 50% refund if less than 50% complete.
- Future unstarted milestones receive a full refund of any deposits paid for those milestones.
3. Deposit Policy
The initial deposit (typically 40% of total project value) secures project scheduling and resource allocation. Deposits are non-refundable once work has commenced on the first milestone. Remaining balance is invoiced upon milestone completion.
4. Subscription & Maintenance Refunds
Monthly maintenance subscriptions can be cancelled with 30 days' notice. No refund is issued for the current billing period. Pre-paid annual subscriptions receive a pro-rata refund for unused months, minus a 10% administrative fee.
5. Dispute Resolution
If you believe a refund is warranted but does not meet the above criteria, submit a written request to [email protected] within 14 days of the relevant invoice date. We will review the request and respond within 10 business days. Disputes that cannot be resolved amicably shall be subject to the jurisdiction of the courts of Lisboa, Portugal.
6. Refund Processing
Approved refunds are processed within 14 business days via the original payment method. Bank transfer refunds may take up to 21 business days depending on the financial institution. Refund notifications are sent to the email address on file.
7. Force Majeure
LumetraPixelStudio is not liable for refunds resulting from delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, or third-party service failures. In such cases, timelines are adjusted proportionally without penalty.
